Perinatal Bereavement Care Legislation in the United States
Understanding Standardized Care and Its Impact on Bereavement Care
For device related questions, please contact usainfo@cuddlecot.com
What is SB 32 Angel's Law in Louisiana?
Louisiana's Angel's Law (Senate Bill 32) directs the Louisiana Department of Health to support hospitals in providing access to perinatal cooling devices like the CuddleCot and strengthening bereavement care for families experiencing the loss of a baby.
The legislation encourages hospitals with maternity units or Neonatal Intensive Care Units (NICUs) to offer compassionate perinatal bereavement support.
As part of the legislation, hospitals are encouraged to:
- Provide families with access to a perinatal cooling device like the CuddleCot, allowing precious additional time with their baby.
- Deliver education and training for healthcare professionals on compassionate bereavement care.
- Work collaboratively with the Louisiana Commission on Perinatal Care and Prevention of Infant Mortality and nonprofit organisations to improve bereavement resources, staff training, and support for grieving families.
The Louisiana Department of Health is responsible for helping implement these initiatives, ensuring hospitals have the resources needed to deliver compassionate, family-centred care during one of life's most difficult moments. Non-profits will also be able to assist in the placement of devices, for a list of non-profits who donate CuddleCots visit: Non-Profits Donating CuddleCots
This important change was led by Kristi Lamarque, Bordelon MSN RNC and Heidi Saint James' Mom, Jamie Jeffrey Strahl, who sadly needed to use a CuddleCot with precious Heidi. Both Moms understand the pain of los and the need for real change in bereavement care, and campaigned tirelessly to pass SB32 Angels Law.
Heidi’s mother, Jamie, shares her powerful story and the importance of compassionate hospital bereavement care in her blog post:
“She Was Alive When I Was Pushing.”

Under proposed R.S. 40:1124.3, the initiative would be administered through the Department’s Office on Women’s Health and Community Health and would aim to:
- Improve access to perinatal bereavement care statewide
- Enhance the quality and consistency of hospital-based loss support
- Provide standardized resources to maternity care providers
The bill directs the Department to coordinate with the Commission on Perinatal Care and Prevention of Infant Mortality and nonprofit organizations to provide hospitals that deliver maternity care with:
1. Staff Training
Education for hospital personnel on compassionate communication and interaction with parents and families following pregnancy or infant loss.
2. Perinatal Bereavement Devices
Access to cooling devices that support memory-making and extended time with a baby after loss. e.g. CuddleCot
3. Family Support Resources
Identification of available grief counseling services, bereavement programs, and support groups for parents and families.
If passed, the initiative would prioritize hospitals that:
- Lack access to a perinatal bereavement device
- Treat a high number of high-risk maternal patients
- Deliver a high number of babies annually
This approach would aim to improve equitable access to bereavement support across both high-volume and high-need facilities.
The proposed legislation authorizes the Louisiana Department of Health to seek and receive:
- Grants
- Gifts and donations
- Other voluntary financial sources
All funds would be used to implement and support the Perinatal Bereavement Care Initiative.
Set to take effect on August 1, 2026 (www.billtrack50.com/billdetail/1963574)

Why the CuddleCot matters - H. Fox, Director of Nursing, Banner Health
A. It’s the right thing to do.
In the face of loss, we can’t change the outcome, but we can change the experience. Providing families with the option of a CuddleCot gives them precious time and space to say goodbye. This support is deeply meaningful, not only to the family, but also to the nurses, providers, and staff who want to offer compassionate, dignified care.
B. It directly impacts patient experience and trust.
When families feel supported during the most vulnerable moments of their lives, they are more likely to feel confident returning to the hospital in the future, especially if they choose to have another child. Positive care experiences influence decisions about where to seek future care.
C. The absence of a CuddleCot can have lasting consequences.
When families later learn that a device like the CuddleCot could have given them more time with their baby, it can add to their pain and lead to feelings of resentment or regret. This can negatively affect their perception of the care they received, and the reputation of the hospital.
D. Personalized care is the most valued element of patient experience.
Studies consistently show that personalized, compassionate care is the number one driver of hospital reputation. Offering a CuddleCot reflects a commitment to individualized, family-centered support during loss.
Everly's Law - Texas
In response to the needs of bereaved families across Texas, House Bill 37 – Everly’s Law introduces a new standard of perinatal bereavement care in hospitals with a maternal level of care designation.
Perinatal bereavement care is supportive care for a prenatal diagnosis of a life-limiting fetal condition.
Set to take effect on September 1, 2025 (https://capitol.texas.gov/tlodocs/89R/billtext/pdf/HB00037F.pdf)
Following an intrauterine fetal demise, neonatal death, or stillbirth, hospitals with a maternal level of care designation shall make available to parents and family members:
(1) perinatal bereavement care counseling options; and
(2) any available perinatal bereavement device
The perinatal bereavement device, if available, should be offered to parents and family members for a period of time equal to the length of stay recommended by a medical professional for a birth.
Everly’s Law defines a perinatal bereavement device as an apparatus with technology capable of delaying the deterioration of human tissue for up to 72 hours following an intrauterine fetal demise, neonatal death, or stillbirth.
H.B 37 does not impact a hospital’s maternal levels of care designation status.
The Executive Commissioner of the Health and Human Services Commission, along with the Perinatal Advisory Council, will develop and implement a program to recognize hospitals assigned a maternal level of care designation that provide perinatal bereavement care training to hospital personnel. More information on this program will be available soon.
For any questions, or to make a donation to the Perinatal Bereavement Care Initiative, please contact PerinatalBereavement@dshs.texas.gov.
We're here to help those planning their responses to HB37 legislation and answer questions about the CuddleCot. Please contact info@cuddlecot.com
The cooling requirement under Texas law applies only after the deceased is under the custody of a licensed funeral director, crematory, or cemetery for final disposition, per Texas Administrative Code §181.4 and Occupations Code §651.401. This does not apply while the baby is still in hospital care.
The CuddleCot is designed to operate at 8˚C/46˚F. Cooling at unnecessarily low temperatures can increase the risk of rapid forming condensation buildup, and in some cases, ice formation or even freezing conditions, which may be distressing for families and inappropriate for close contact.
The CuddleCot avoids these risks by maintaining a steady, verifiable temperature (displayed clearly on the unit), in full alignment with HB 37 requirements. It delivers effective, gentle cooling to enable parents to spend precious moments together.
“It’s hard on the staff, too, and helpful to know you gave the parents the chance to create that bond.” – Nurse Laird, Tidelands Health
In 2023, Tidelands Health became the first hospital in South Carolina and only the second in the U.S. to achieve advanced perinatal care certification from The Joint Commission and the American College of Obstetrics and Gynecologists. (source)
What Is a CuddleCot?
A CuddleCot is a recognized perinatal cooling device designed to provide continuous, controlled cooling for a pre-term or full-term baby after death. It is used internationally to support best practice bereavement care and aligns with discreet and compassionate cooling and care principles.
The CuddleCot uses a flexible, temperature-controlled cooling pad placed beneath the baby. This design ensures consistent, verifiable cooling contact, helping maintain temperature stability while avoiding the risks associated with ice packs, refrigerated boxes, or intermittent cooling methods.
By delivering gentle, regulated cooling, the CuddleCot helps hospitals:
Reduce condensation and moisture
Eliminate icing and sudden temperature drops
Support dignified, family-centred bereavement care
The temperature-controlled pad can be wrapped in the baby’s own blankets and used in any bassinet or while the baby is held by parents. This allows families to spend meaningful time together without interrupting cooling, supporting both clinical best practice and compassionate care.

How the CuddleCot Package Supports Your Facility
"What Is a Perinatal Cooling Device and How Does It Help Grieving Families?”
The CuddleCot is a recognized perinatal bereavement care device already trusted in thousands of hospitals across the United States. It allows families precious time to say goodbye in a private, supported setting by gently slowing natural changes to the baby’s condition.
We offer more than just portable continual cooling for pre- and full-term babies in any setting.
We provide complimentary, clinically-led online e-learning for healthcare professionals, access to our directory of bereavement care resources, standardization documents, 1:1 video support and more as standard. Our goal is to help teams strengthen their bereavement programs and ensure every family has equal access to quality bereavement care.
By incorporating the CuddleCot into your response to HB37, your hospital can:
- Meet the device access requirement
- Support family-centered bereavement care
- Empower staff with a gentle, evidence-based tool
- Strengthen eligibility for future recognition and grant support
- Train staff with evidence based bereavement care e-Learning for free

Where is the CuddleCot used?
The CuddleCot is compact, discreet, and used across various healthcare departments that support families experiencing loss, including:
- Labor & Delivery
- ICU
- Mother & Baby
- NICU
- Pediatrics
- Emergency Department
The CuddleCot is used in medical centers of all sizes. Including large hospitals, small clinics, and rural facilities, so families everywhere can have the gift of extra time with their baby.
To ensure equitable access to bereavement care, we recommend departments provide at least one cooling device per 1,000 births annually. For example, a facility with 5,000 births per year should have a minimum of five CuddleCots available.
Every family deserves the opportunity to choose what their care looks like — including access to cooling and meaningful bereavement support.
Could your team offer cooling if a family asked for it? Would they feel confident supporting a grieving family?

Clinical Research Into Cooling Experiences
A multi-site qualitative study of bereaved parents’ experiences of using cooling facilities Julia Hackett, Emily Heavey and Bryony Beresford
Evidence on the benefits to parents of spending time with their child in the hours after their death means this is now routine practice. This study offered parents the opportunity to extend this period by using cooling facilities (i.e. CuddleCot for pre- full-term babies/ CuddleBlankets for older children) to slow natural changes.
Aim: To explore parents’ experiences of using cooling facilities and beliefs about how it shaped experiences of the very early days of bereavement, and on-going grieving processes. The multi-site study involved in-depth interviews with parents bereaved in the previous 3 years. Grief theories informed data analysis, which employed narrative and thematic approaches.

‘It was like an airbag, it cushioned the blow’
Results: Twenty-two mothers and eight fathers were recruited. Duration of use of a cooling facility varied, as did the amount of time spent with the child. All parents treasured this period, valuing the way it eased separation from their child and gave some control over when this happened. They believed all bereaved parents should have the opportunity to use a cooling facility.
Using a cooling facility supported parents’ engagement with grief tasks including acceptance of loss, processing emotional pain and facing changes to their lives brought about by their child’s death.
Memories and mementoes created during this period served to support on-going connections with the child.
